(1) Sind nach diesem Abkommen Einkünfte oder Veräuße-
rungsgewinne aus Quellen in einem Vertragsstaat ganz oder
teilweise in diesem Staat von der Steuer befreit und ist eine Per-
son hinsichtlich dieser Einkünfte oder Veräußerungsgewinne
gemäß dem im anderen Vertragsstaat geltenden Recht für den
Betrag der Einkünfte oder Veräußerungsgewinne, der in den
anderen Staat überwiesen oder dort bezogen wird, nicht aber
für den Gesamtbetrag dieser Einkünfte oder Veräußerungs-
gewinne steuerpflichtig, so ist die nach diesem Abkommen zu
gewährende Steuerbefreiung nur auf den Teil der Einkünfte oder
Veräußerungsgewinne anzuwenden, der im anderen Vertrags-
staat der Steuer unterliegt.
English
(1) Where under any provision of this Agreement income or
capital gains arising in a Contracting State is or are relieved in
whole or in part from tax in that State and under the law in force
in the other Contracting State a person, in respect of the said
income or capital gains, is subject to tax by reference to the
amount thereof which is remitted to or received in that other
State and not by reference to the full amount thereof, then any
relief provided by the provisions of this Agreement shall apply
only to so much of the income or capital gains as is or are taxed
in the other Contracting State.
(2) Diese Einschränkung gilt jedoch nicht für Einkünfte oder
Veräußerungsgewinne der Regierung eines Vertragsstaates
oder einer von den zuständigen Behörden beider Staaten für
die Zwecke dieses Absatzes anerkannten Person. Der Begriff
„Regierung“ umfasst ihre Behörden und Körperschaften.

any person approved by the competent authorities of both
States for the purpose of this paragraph. The term “Govern-
ment” shall include its agencies and statutory bodies.
