§
- 1. Notwithstanding any other provision of this Convention, relief from tax provided for in the Convention shall not be granted to an individual by a Contracting State in respect of income from sources within that Contracting State if the individual is subject to tax in the other Contracting State by reference only to the amount of his income which is remitted to or received in that other Contracting State and not by reference to the full amount of his worldwide income. However, where the income of such individual that is not remitted to or received in that other State is less than £ 2,000 (or the equivalent in euro) in a tax year, the first-mentioned State shall grant the relief from tax provided for in the Convention with regard to income that is remitted to or received in the other Contracting State.
§
- 2. Subject to the provisions of paragraph (4) of this Article, individuals who are residents of Belgium shall be entitled to the same personal allowances, reliefs and reductions for the purposes of United Kingdom taxation as British subjects not resident in the United Kingdom.
§
- 3. Subject to the provisions of paragraph 4 of this Article, individuals who are residents of the United Kingdom shall be entitled to the same personal allowances, reliefs and reductions for the purposes of Belgian taxation as Belgian nationals not resident in Belgium.
§
- 4. Nothing in the Convention shall entitle an individual who is a resident of a Contracting State and whose income from the other Contracting State consists solely of dividends, interest or royalties (or solely of any combination thereof) to the personal allowances, reliefs and reductions of the kind referred to in paragraphs 2 and 3 of this Article for the purpose of taxation in that other State.
§
- 5. [REPLACED by paragraph 1 of Article 11 of the MLI] (Refer to the box following Article 1 of the Convention) [The provisions of the Convention shall not limit the taxation in accordance with Belgian law of a company which is a resident of Belgium, in the event of the purchase of its own shares or in the event of the distribution of its assets.]
§
- 6. The provisions of the Convention shall not be construed so as to restrict in any manner any exemption, relief, deduction, credit or other allowance now or hereafter accorded by the laws of either Contracting State in determining the tax in that State.
§
- 7. The competent authorities of the Contracting States may settle by mutual agreement the conditions under which a collective investment vehicle which is established in a Contracting State and is not liable to tax as such in that State and which receives dividends or interest arising in the other Contracting State shall be treated for purposes of applying the Convention to such income as an individual resident of the Contracting State in which it is established and as the beneficial owner of the income it receives.
§
The following paragraph 1 of Article 7 of the MLI replaces paragraph 8 of Article 10, paragraph 8 of Article 11, paragraph 6 of Article 12, paragraph 5 of Article 22 and paragraph 4 of Article 23:
§
Article 7 of the MLI – prevention of treaty abuse
§
(Principal purposes test provision)
§
Notwithstanding any provisions of [the Convention], a benefit under [the Convention] shall not be granted in respect of an item of income or capital if it is reasonable to conclude, having regard to all relevant facts and circumstances, that obtaining that benefit was one of the principal purposes of any arrangement or transaction that resulted directly or indirectly in that benefit, unless it is established that granting that benefit in these circumstances would be in accordance with the object and purpose of the relevant provisions of [the Convention].
§
The following paragraph 4 of Article 7 of the MLI applies to paragraph 1 of Article 7 of the MLI:
§
Where a benefit under [the Convention] is denied to a person under [paragraph 1 of Article 7 of the MLI], the competent authority of the [Contracting State] that would otherwise have granted this benefit shall nevertheless treat that person as being entitled to this benefit, or to different benefits with respect to a specific item of income or capital, if such competent authority, upon request from that person and after consideration of the relevant facts and circumstances, determines that such benefits would have been granted to that person in the absence of the transaction or arrangement referred to in [paragraph 1 of Article 7 of the MLI]. The competent authority of the [Contracting State] to which a request has been made under this paragraph by a resident of the other [Contracting State] shall consult with the competent authority of that other [Contracting State] before rejecting the request.

Edition notes and known limitations

HMRC publisher synthesis; not an authentic signed instrument. Authentic treaty and MLI texts prevail. Currentness not checked.

Complete substantive publisher content and true end-of-publication are evidenced; no diplomatic closing is printed or fabricated.

No Original PDF, authentic instrument or physical-facsimile wording claim. Native extraction can flatten MLI boxes and ordered-list styling.

Publisher “in force” wording is retained as source wording, not adopted as a current-law badge.

Publisher preface, references, general MLI effect conditions and modified preamble are top-level searchable supplements. Inline MLI qualifications and box references remain in their articles.

Publication title/index protocol-year terminology is not silently reconciled with the body’s dated protocol references.

Italy remains outside this candidate; no full-reader or goal-credit change.

Source authority, text completeness and currentness still require human review.
