§
## ARTICLE XVII Withholding of Taxes in Respect of Independent Personal Services
§
- 1 Deduction and withholding of tax on account of the tax liability for a taxable year on remuneration paid to an individual who is a resident of a Contracting State (including an entertainer or athlete) in respect of the performance of independent personal services in the other Contracting State may be required by that other State, but with respect to the first five thousand dollars ($5,000) in the currency of that other State, paid as remuneration in that taxable year by each payer, such deduction and withholding shall not exceed 10 per cent of the payment. - 2 Where the competent authority of a Contracting State considers that an amount that would otherwise be deducted or withheld from any amount paid or credited to an individual who is a resident of the other Contracting State in respect of the performance of independent personal services in the first-mentioned State is excessive in relation to the estimated tax liability for the taxable year of that individual in the first-mentioned State, it may determine that a lesser amount will be deducted or withheld. - 3 The provisions of this Article shall not affect the liability of a resident of a Contracting State referred to in paragraph 1 or 2 for tax imposed by the other Contracting State.

Edition notes and known limitations

This Schedule I preserves the base convention article sequence I–XXXI. It does not silently apply the separately printed amending protocols in Schedules II–VI.

Complete official XML of the Act and five amending protocols is separately retained under xml/ca-us-1980-with-protocols/.

Source-page annexes and diplomatic notes are retained as supplements, not appended to Article XXXI.

Capture SHA256 identifies complete retained publisher-text extraction, not original HTML transport bytes or any PDF.

Full capture/provenance: html/ca-us-1980-schedule/proof.json

v3 clean source sections: top-level searchable supplements have exact source offsets/hashes. Government navigation/footer and implementing-order explanatory notes remain in capture but are not treaty/legal supplement units.

Source authority, text completeness and currentness still require human review.
