(1) Dieses Abkommen ist nicht so auszulegen, als
a) hindere es einen Vertragsstaat, seine innerstaatlichen
Rechtsvorschriften zur Verhinderung der Steuerumgehung
oder Steuerhinterziehung anzuwenden;
b) hindere es die Bundesrepublik Deutschland, Beträge zu be-
steuern, die nach dem Vierten Teil des deutschen Außensteu-
ergesetzes dem Einkommen einer in der Bundesrepublik
Deutschland ansässigen Person zuzurechnen sind.
(2) Führt Absatz 1 zu einer Doppelbesteuerung, konsultieren
die zuständigen Behörden einander nach Artikel 25 Absatz 3, wie
die Doppelbesteuerung zu vermeiden ist.
