(1) Einkünfte, die eine in einem Vertragstaat ansässige
Person aus einem freien Beruf oder aus sonstiger selb-
ständiger Tätigkeit ähnlicher Art bezieht, können nur in
diesem Staat besteuert werden, es sei denn, daß der
Beruf oder die Tätigkeit in dem anderen Vertragstaat
während insgesamt 30 Tagen innerhalb eines Zeitraums
von 12 Monaten ausgeübt wird und die Vergütungen
dafür von einer Betriebstätte in dem anderen Vertrag-
staat oder einer dort ansässigen Person getragen werden.
In diesem Fall können die Einkünfte in dem anderen
Staat besteuert werden.
(2) Der Ausdruck „freier Beruf” umfaßt insbesondere
die selbständig ausgeübte wissenschaftliche, literarische,
künstlerische, erzieherische oder unterrichtende Tätigkeit
sowie die selbständige Tätigkeit der Ärzte, Rechtsan-
wälte, Ingenieure, Architekten, Zahnärzte und der Ange-
hörigen der wirtschafts- und steuerberatenden Berufe.
