(1) Einkünfte, die eine in einem Vertragsstaat ansässige natür-
liche Person aus einem freien Beruf oder aus sonstiger selbstän-
diger Tätigkeit bezieht, können nur in diesem Staat besteuert
werden, es sei denn, dass der Person im anderen Vertragsstaat
für die Ausübung ihrer Tätigkeit gewöhnlich eine feste Einrich-
tung zur Verfügung steht. Steht ihr eine solche feste Einrichtung
zur Verfügung, so können die Einkünfte im anderen Staat be-
steuert werden, jedoch nur insoweit, als sie dieser festen Einrich-
tung zugerechnet werden können. Wenn sich eine in einem Ver-
tragsstaat ansässige natürliche Person im anderen Vertragsstaat
insgesamt länger als 183 Tage innerhalb eines Zeitraums von
12 Monaten, der während des betreffenden Steuerjahres beginnt
oder endet, aufhält, so wird für die Zwecke dieses Abkommens
davon ausgegangen, dass ihr in diesem anderen Staat gewöhn-
lich eine feste Einrichtung zur Verfügung steht und dass die
aus ihrer im anderen Staat ausgeübten Tätigkeit bezogenen Ein-
künfte dieser festen Einrichtung zugerechnet werden können.
(2) Der Ausdruck „freier Beruf“ umfasst insbesondere die selb-
ständig ausgeübte wissenschaftliche, literarische, künstlerische,
erzieherische oder unterrichtende Tätigkeit sowie die selb-
ständige Tätigkeit der Ärzte, Zahnärzte, Rechtsanwälte, Inge-
nieure, Architekten und Buchsachverständigen.
