1. Несмотря на положения статей 7, 14 и 15 настоящего
Соглашения, доходы, получаемые резидентом Договари-
вающегося Государства в качестве артиста-исполнителя,
такого, как артиста театра, кино, радио и телевидения, или
музыканта, а также в качестве спортсмена от его лично
осуществляемой деятельности в другом Договаривающем-
ся Государстве, могут облагаться налогом в этом другом
Государстве.
2. В случае если доходы от осуществляемой лично ар-
тистом или спортсменом в таком своем качестве деятель-
ности начисляются не самому артисту или спортсмену, а
иному лицу, то эти доходы, несмотря на положения статей 7,
14 и 15 настоящего Соглашения, могут облагаться налогом
в том Договаривающемся Государстве, в котором артист
или спортсмен осуществляет свою деятельность.
3. Положения пунктов 1 и 2 настоящей статьи не при-
меняются к доходам от деятельности, осуществляемой ар-
тистами или спортсменами в Договаривающемся Государ-
стве, если их пребывание в этом Государстве полностью или
преимущественно финансируется за счет государственных
средств другого Договаривающегося Государства, одной из
его земель или одного из их административно-террито-
риальных образований, либо некоммерческой организа-
цией, признанной в этом другом Государстве общественно
полезной. В таком случае доходы могут облагаться только в
Договаривающемся Государстве, резидентом которого
является артист или спортсмен.
