1. Независимо от положений статей 7, 14 и 15 настояще-
го Соглашения, доход, получаемый резидентом Договари-
вающегося Государства в качестве работника искусств,
такого как артист театра, кино, радио и телевидения, или
музыканта, или в качестве спортсмена от его личной дея-
тельности, осуществляемой в другом Договаривающемся
Государстве, может облагаться налогом в этом другом Госу-
дарстве.
2. В случае если доходы от деятельности, лично осу-
ществляемой артистом или спортсменом в этом его ка-
честве, начисляются не самому артисту или спортсмену, а
иному лицу, то эти доходы, несмотря на положения статей 7,
14 и 15 настоящего Соглашения, могут облагаться налогом
в том Договаривающемся Государстве, в котором артист
или спортсмен осуществляет свою деятельность.
3. Положения пунктов 1 и 2 настоящей статьи не при-
меняются к доходам от деятельности, осуществляемой ар-
тистами или спортсменами в Договаривающемся Государст-
ве, если их пребывание в этом Государстве полностью или
преимущественно финансируется за счет государственных
средств другого Договаривающегося Государства или его
административно-территориальных образований, либо ор-
ганизацией, признанной в этом другом Государстве общест-
венно полезной (благотворительной). В таком случае дохо-
ды могут облагаться только в Договаривающемся Государ-
стве, резидентом которого является артист или спортсмен.
