1. Настоящее Соглашение применяется к налогам на до-
ходы и имущество, взимаемым от имени Договаривающе-
гося Государства или одного из его административно-терри-
ториальных образований, независимо от способа и метода
их взимания.
2. Налогами на доходы и имущество считаются все на-
логи, взимаемые с общей суммы дохода, совокупного иму-
щества или с отдельных элементов дохода или имущества,
включая налоги с доходов от отчуждения движимого или
недвижимого имущества, налоги, взимаемые с фонда зара-
ботной платы, выплачиваемой предприятиями, а также на-
логи, взимаемые с доходов от прироста имущества.
3. Существующими налогами, на которые распространя-
ется действие настоящего Соглашения, являются, в част-
ности:
a) в Федеративной Республике Германия:
подоходный налог,
налог с корпораций
промысловый налог и
налог на имущество,
включая налоговые надбавки к ним
(далее именуемые «германские налоги»);
b) в Кыргызской Республике:
налог на прибыль и доходы с юридических лиц,
подоходный налог физических лиц
(далее именуемые «кыргызские налоги»).
4. Настоящее Соглашение применяется также к любым
идентичным или по существу аналогичным налогам, кото-
рые будут взиматься после даты подписания настоящего
Соглашения в дополнение или вместо существующих на-
логов. Компетентные органы Договаривающихся Государств
будут уведомлять друг друга о любых существенных изме-
нениях, которые будут внесены в их соответствующие на-
логовые законодательства.
