(1) Einkünfte einer in einem Vertragsstaat ansässigen Per-
son, die in den vorstehenden Artikeln nicht behandelt wurden,
können nur in diesem Vertragsstaat besteuert werden. Wer-
den die Einkünfte jedoch aus Quellen innerhalb des anderen
Vertragsstaats bezogen, so können sie auch im anderen Staat
besteuert werden.
(2) Absatz 1 ist nicht anzuwenden, wenn der in einem Ver-
tragsstaat ansässige Empfänger der Einkünfte im anderen
Vertragsstaat eine gewerbliche Tätigkeit durch eine dort gele-
gene Betriebstätte oder eine freiberufliche Tätigkeit durch eine
dort gelegene feste Einrichtung ausübt, und die Rechte oder
Vermögenswerte, für welche die Einkünfte gezahlt werden,
tatsächlich zu dieser Betriebstätte oder festen Einrichtung ge-
hören. In diesem Fall ist Artikel 7 beziehungsweise Artikel 14
anzuwenden.
