(1) Sopimusvaltioiden toimivaltaisten viranomaisten on
vaihdettava keskenään sellaisia tietoja, jotka ovat ennalta
arvioiden olennaisia tämän sopimuksen soveltamiseksi tai
sopimusvaltioiden, osavaltion tai sopimusvaltion tai osavaltion
valtiollisen osan tai paikallisviranomaisen lukuun määrättäviä
kaikenlaatuisia veroja koskevan sisäisen lainsäädännön
hallinnoimiseksi tai toimeenpanemiseksi, mikäli tämän
lainsäädännön perusteella tapahtuva verotus ei ole tämän
sopimuksen vastainen. Sopimuksen 1 ja 2 artikla eivät rajoita
tietojen vaihtamista.
(2) Sopimusvaltion 1 kappaleen perusteella vastaanottamia
toimia. Näiden henkilöiden tai viranomaisten on käytettävä tietoja
vain tällaisiin tarkoituksiin. Ne saavat ilmaista tietoja julkisessa
oikeudenkäynnissä tai tuomioistuimen ratkaisuissa. Edellä
olevien määräysten estämättä tietoja voidaan käyttää muihin
tarkoituksiin, jos niitä voidaan käyttää näihin muihin tarkoituksiin
kummankin valtion lainsäädännön mukaan ja tietoja antavan
valtion toimivaltainen viranomainen on antanut luvan tähän
käyttöön.
(3) Tämän artiklan 1 ja 2 kappaleen ei missään tapauksessa
katsota velvoittavan sopimusvaltiota,
a) ryhtymään tietojen antamista varten sellaisiin hallintotoimiin,
jotka poikkeavat tämän sopimusvaltion tai toisen
sopimusvaltion lainsäädännöstä ja hallintokäytännöstä;
b) antamaan tietoja, joita tämän tai toisen sopimusvaltion
lainsäädännön
mukaan
tai
säännönmukaisen
hallintomenettelyn puitteissa ei voida hankkia;
c) antamaan tietoja, jotka paljastaisivat liikesalaisuuden taikka
teollisen, kaupallisen tai ammatillisen salaisuuden tai
elinkeinotoiminnassa käytetyn menettelytavan, taikka tietoja,
joiden ilmaiseminen olisi vastoin yleistä järjestystä (ordre
public).
(4) Jos sopimusvaltio pyytää tietoja tämän artiklan mukaisesti,
toisen sopimusvaltion on käytettävä tietojenhankintakeinojaan

Currentness
Original source edition; not a verified current-law consolidation. Unknown as current law. Signed 2016-02-19; consent law 2017-04-25; gazette publication 2017-04-28. Edition ID year is not a signature date. Treaty entry into force: not resolved as a single source-bound field by the retained audit. Roster general application: 2018-01-01 (not a universal tax-specific rule). Cached official article entry statements (may refer to multiple instruments): 16. November 2017, 25. Februar 2021. Evidence is the retained 2026-10-01 agent audit of source PDF, 2026-01-01 roster and cached official HTML, not a fresh current-law determination.
