(1) Для целей настоящего Соглашения термин „резидент
Договаривающегося Государства“ означает любое лицо,
которое по законодательству этого Государства подлежит в
нем налогообложению на основе своего местожительства,
своего постоянного местопребывания, места нахождения
своего руководящего органа или иного аналогичного крите-
рия, включая также само это Государство, его земли и их ад-
министративно-территориальные образования. Указанный
термин не распространяется, однако, на лицо, которое
подлежит налогообложению в этом Государстве только в
отношении доходов из источников в этом Государстве или в
отношении имущества, расположенного в этом Государстве.
(2) В случае, если согласно положениям пункта 1 настоя-
щей статьи физическое лицо является резидентом обоих
Договаривающихся Государств, действуют следующие
положения:
а) лицо считается резидентом того Государства, в котором
оно располагает постоянным жилищем; если оно распо-
лагает постоянным жилищем в обоих Государствах, то
оно считается резидентом только того Государства, с
которым оно имеет наиболее тесные личные и экономи-
ческие связи (центр жизненных интересов);
b) в случае, если не может быть определено, в каком
Государстве лицо имеет центр жизненных интересов, или
если лицо не располагает постоянным жилищем ни в
одном из Государств, оно считается резидентом только
того Государства, в котором оно обычно проживает;
с) если лицо обычно проживает в обоих Государствах
или если оно обычно не проживает ни в одном из них,
оно считается резидентом только того Государства,
гражданином которого оно является;
d) если лицо является гражданином обоих Государств
или ни одного из них, то компетентные органы Договари-
вающихся Государств решают этот вопрос по взаимному
согласию.
(3) В случае, если в соответствии с положениями пункта 1
настоящей статьи лицо, иное, чем физическое лицо, являет-
ся резидентом обоих Договаривающихся Государств,
то оно считается резидентом того Договаривающегося
Государства, в котором расположено место нахождения
его фактического руководящего органа.
