(1) Для целей настоящего Соглашения, если иное не
вытекает из контекста:
a) термин „Туркменистан“ охватывает территорию Туркме-
нистана, над которой Туркменистан осуществляет свои
суверенные права и юрисдикцию согласно международ-
ному праву;
b) термин „Федеративная Республика Германия“ охватывает
территорию Федеративной Республики Германия, а также
прилегающий к территориальному морю район морского
дна, его недр, а также расположенной над ними водной
толщи, в котором Федеративная Республика Германия в
соответствии с международным правом и национальным
законодательством осуществляет суверенные права и
юрисдикцию в целях разведки, разработки, сохранения
природных ресурсов, как живых, так и неживых, а также
в целях управления ими;
c) термины „Договаривающееся Государство“ и „другое До-
говаривающееся Государство“ означают Федеративную
Республику Германия или Туркменистан, в зависимости
от контекста;
d) термин „лицо“ включает физическое лицо, компанию и
любое другое объединение лиц;
e) термин „компания“ означает юридическое лицо или
правовой субъект, который для целей налогообложения
рассматривается как юридическое лицо;
f) термины „предприятие Договаривающегося Государства“
и „предприятие другого Договаривающегося Государст-
ва“ соответственно означают предприятие, управляемое
лицом, являющимся резидентом Договаривающегося
Государства, или предприятие, управляемое лицом,
являющимся резидентом другого Договаривающегося
Государства;
g) термин „международные перевозки“ означает любую
перевозку морским или воздушным судном, эксплуати-
руемым предприятием с местом фактического руководя-
щего органа в Договаривающемся Государстве, кроме
случаев, когда морское или воздушное судно эксплуати-
руется исключительно между пунктами, расположенными
в другом Договаривающемся Государстве;
h) термин „национальное лицо“ означает:
аа) применительно к Федеративной Республике Герма-
ния:
любого немца в понимании Основного закона Феде-
ративной Республики Германия, а также любое юри-
дическое лицо, товарищество и иное объединение
лиц, учрежденные в соответствии с действующим в
Федеративной Республике Германия законодатель-
ством;
bb) применительно к Туркменистану:
любое физическое лицо, имеющее гражданство
Туркменистана, а также любое юридическое лицо,
товарищество и иное объединение лиц, учрежден-
ные в соответствии с действующим в Туркменистане
законодательством;
i)
термин „компетентный орган“ означает:
аа) применительно к Федеративной Республике Герма-
ния – Федеральное министерство финансов или
орган, которому оно передало свои полномочия;
bb) применительно к Туркменистану – Министерство фи-
нансов Туркменистана и Главная государственная
налоговая служба Туркменистана или их полномоч-
ный представитель.
(2) Если из контекста не вытекает иное, то при примене-
нии Договаривающимся Государством настоящего Соглаше-
ния любой не определенный в Соглашении термин имеет
то значение, которое в период действия настоящего Согла-
шения ему придает законодательство этого Государства о
налогах, на которые распространяется действие настоящего
Соглашения, причем значение согласно применяемому в
этом Государстве налоговому законодательству преобладает
над каким-либо значением, которое термин имеет в соответ-
ствии с другой правовой отраслью данного Государства.
