(1) Доходы, получаемые резидентом Договаривающегося
Государства от оказания профессиональных услуг или дру-
гой деятельности независимого характера, могут облагаться
налогом только в этом Государстве, если только он не имеет
в другом Договаривающемся Государстве регулярно доступ-
ную постоянную базу для осуществления своей деятельно-
сти. Если он имеет такую постоянную базу, то доходы могут
облагаться налогом в этом другом Государстве, но только в
той части, которая может быть отнесена к этой постоянной
базе. Если физическое лицо, являющееся резидентом Дого-
варивающегося Государства, пребывает в другом Договари-
вающемся Государстве в течение периода или периодов,
превышающих в общей сложности 183 дня в любом двена-
дцатимесячном периоде, начинающем или заканчивающем
в соответствующем налоговом году, то оно считается имею-
щимся регулярно доступную постоянную базу в этом другом
Государстве, и доходы от осуществления в этом другом
Государстве упомянутой выше деятельности могут быть
отнесены к этой постоянной базе. В таком случае доходы,
относящиеся к постоянной базе, могут облагаться налогом
в этом другом Государстве в соответствии с принципами,
аналогичными тем, которые изложены в статье 7 настоящего
Соглашения для исчисления суммы предпринимательской
прибыли и ее отнесения к постоянному представительству.
(2) Термин „профессиональные услуги“ включает, в част-
ности, независимо осуществляемую научную, литературную,
воспитательную или преподавательскую деятельность, не-
зависимо осуществляемую деятельность в области искусств,
а также независимую деятельность врачей, стоматологов,
адвокатов, инженеров, архитекторов и экспертов в области
бухгалтерского дела.
