(1) Dieses Abkommen tritt an dem Tag in Kraft, an dem die
Vertragsstaaten einander notifiziert haben, dass die innerstaat-
lichen Voraussetzungen für sein Inkrafttreten erfüllt sind. Maß-
geblich ist der Tag des Eingangs der letzten Notifikation.
(2) Dieses Abkommen findet Anwendung
a) in der Bundesrepublik Deutschland
aa) bei den im Abzugsweg erhobenen Steuern auf die
Beträge, die am oder nach dem 1. Januar des Kalen-
derjahrs gezahlt werden, das dem Jahr folgt, in dem
das Abkommen in Kraft getreten ist;
bb) bei den übrigen Steuern auf die Steuern, die für Zeit-
räume ab dem 1. Januar des Kalenderjahrs erhoben
werden, das auf das Jahr folgt, in dem das Abkommen
in Kraft getreten ist;
b) in Malaysia
aa) bei den malaysischen Steuern, die nicht Steuern auf
Einnahmen aus der Erdölförderung sind, auf die Steu-
ern, die für Veranlagungszeiträume ab dem 1. Januar
des Kalenderjahres erhoben werden, das auf das Jahr
folgt, in dem das Abkommen in Kraft getreten ist;
bb) bei der Steuer auf Einnahmen aus der Erdölförderung
auf die Steuern, die für Veranlagungszeiträume ab dem
1. Januar des zweiten Kalenderjahres erhoben werden,
das auf das Jahr folgt, in dem das Abkommen in Kraft
getreten ist.
(3) Mit dem Datum des Inkrafttretens dieses Abkommens
tritt das Abkommen vom 8. April 1977 zwischen der Bundesre-
publik Deutschland und Malaysia zur Vermeidung der Doppel-
besteuerung auf dem Gebiet der Steuern vom Einkommen und
vom Vermögen und in Bezug auf andere damit zusammenhän-
gende Fragen für alle nach diesem Abkommen geregelten Fälle
außer Kraft.
