(1) Einkünfte einer in einem Vertragsstaat ansässigen Person,

ohne Rücksicht auf ihre Herkunft nur in diesem Staat besteuert

(1) Доходы, получаемые резидентом Договаривающегося
Государства, которые не рассматривались в предыдущих
статьях настоящего Соглашения, независимо от их про-
исхождения могут облагаться налогом только в этом
Государстве.
(2) Absatz 1 ist auf andere Einkünfte als solche aus unbeweg-
lichem Vermögen nicht anzuwenden, wenn der in einem Ver-
tragsstaat ansässige Empfänger im anderen Vertragsstaat eine
gewerbliche Tätigkeit durch eine dort gelegene Betriebsstätte
oder eine selbständige Arbeit durch eine dort gelegene feste
Einrichtung ausübt und die Rechte oder Vermögenswerte, für die
die Einkünfte gezahlt werden, tatsächlich zu dieser Betriebsstätte
oder festen Einrichtung gehören. In diesem Fall ist Artikel 7
beziehungsweise Artikel 14 anzuwenden.

(2) Положения пункта 1 настоящей статьи не применяются
к доходам, иным, чем доходы от недвижимого имущества,
если получатель, являющийся резидентом Договаривающе-
гося Государства, осуществляет в другом Договаривающем-
ся Государстве предпринимательскую деятельность через
расположенное в нем постоянное представительство или
оказывает в этом другом Государстве независимые личные
услуги через находящуюся в нем постоянную базу, и
права или имущественные ценности, в отношении которых
выплачиваются эти доходы, реально связаны с таким
постоянным представительством или такой постоянной
базой. В таком случае применяются положения статьи 7 или
статьи 14 настоящего Соглашения.
