(1) Ungeachtet der Artikel 14 und 15 können Einkünfte,
die berufsmäßige Künstler, wie Bühnen-, Film-, Rundfunk-
oder Fernsehkünstler und Musiker, sowie Sportler aus
ihrer in dieser Eigenschaft persönlich ausgeübten Tätig-
keit beziehen, in dem Vertragstaat besteuert werden, in
dem sie diese Tätigkeit ausüben.

(1) Notwithstanding the provisions of Articles 14 and
15, income derived by public entertainers, such as
theatre, motion picture, radio or television artists, and
musicians, and by athletes, from their personal activities
as such may be taxed in the Contracting State in which
these activities are exercised.
(2) Erbringt ein Unternehmen eines Vertragstaates in
dem anderen Vertragstaat die Darbietungen eines in Ab-
satz 1 erwähnten berufsmäßigen Künstlers oder Sportlers,
so können die Gewinne aus dem Erbringen dieser Darbie-
tungen ungeachtet anderer Bestimmungen dieses Abkom-
mens in dem anderen Staat besteuert werden, wenn der
auftretende berufsmäßige Künstler oder Sportler dieses
Unternehmen unmittelbar oder mittelbar beherrscht.

(2) Notwithstanding anything contained in this Agree-
ment, where the services of a public entertainer or an
athlete mentioned in paragraph (1) are provided in a
Contracting State by an enterprise of the other Con-
tracting State, the profits derived from providing those
services by such enterprise may be taxed in the first-
mentioned State if the public entertainer or the athlete
performing the services controls, directly or indirectly,
such enterprise.
