(1) Einkünfte einer in einem Vertragsstaat ansässigen Per-
son, die in den vorstehenden Artikeln nicht behandelt wurden,
können ohne Rücksicht auf ihre Herkunft nur in diesem Staat
besteuert werden.

1. Доходы, получаемые резидентом Договаривающегося
Государства, которые не рассматривались в предыдущих
статьях настоящего Соглашения, независимо от их проис-
хождения могут облагаться налогом только в этом Госу-
дарстве.
(2) Absatz 1 ist auf andere Einkünfte als solche aus unbe-
weglichem Vermögen im Sinne des Artikels 6 Absatz 2 nicht
anzuwenden, wenn der in einem Vertragsstaat ansässige Emp-
fänger im anderen Vertragsstaat eine gewerbliche Tätigkeit
durch eine dort gelegene Betriebsstätte oder eine selbständige
Arbeit durch eine dort gelegene feste Einrichtung ausübt und
die Rechte oder Vermögenswerte, für die die Einkünfte gezahlt
werden, tatsächlich zu dieser Betriebsstätte oder festen
Einrichtung gehören. In diesem Fall ist Artikel 7 beziehungs-
weise Artikel 14 anzuwenden.

2. Положения пункта 1 настоящей статьи не применя-
ются к доходам, иным, чем доходы от недвижимого иму-
щества согласно пункту 2 статьи 6 настоящего Соглашения,
если получатель таких доходов, являющийся резидентом
Договаривающегося Государства, осуществляет в другом До-
говаривающемся Государстве предпринимательскую деятель-
ность через расположенное в нем постоянное учреждение
или оказывает в этом другом Государстве независимые
личные услуги через находящуюся в нем постоянную базу,
и право или имущество, в отношении которых выпла-
чиваются эти доходы, реально связаны с таким постоян-
ным учреждением или такой постоянной базой. В таком
случае применяются положения статьи 7 или статьи 14
настоящего Соглашения, в зависимости от обстоятельств.
