(1) Le présent Accord entre en vigueur à
la date à laquelle les États contractants se
notifient mutuellement que les exigences
nationales requises pour ladite entrée en
vigueur ont été remplies. La date pertinen-
te est le jour où la dernière des notifications
est reçue. Les dispositions de l’Accord
sont applicables:
a) à l'égard de l'impôt retenu à la source
sur les montants payés à des non-rési-
dents, ou portés à leur crédit, le 1er jan-
vier 2001 ou après cette date; et
b) à l'égard des autres impôts, pour toute
année d'imposition commençant le 1er
janvier 2001 où après cette date.
(2) L’Accord entre le Canada et la Répu-
blique fédérale d'Allemagne en vue d’éviter
les doubles impositions en matière d'im-
pôts sur le revenu et de certains autres
impôts, signé à Ottawa le 17 juillet 1981
cesse d'avoir effet à l'égard des impôts
auxquels s'applique le présent Accord
conformément aux dispositions du para-
graphe 1 et est abrogé à compter de la
date à laquelle il a effet pour la dernière fois
conformément aux dispositions précé-
dentes.
(3) Dans le cas où une disposition de
l’Accord entre le Canada et la République
fédérale d'Allemagne en vue d’éviter les
doubles impositions en matière d'impôts
sur le revenu et de certains autres impôts,
signé à Ottawa le 17 juillet 1981 accorde-
rait un allégement plus favorable que celui
accordé en vertu du présent Accord, ladite
disposition continue d’avoir effet jusqu’à la
fin de l’année d’imposition au cours de
laquelle le présent Accord entre en vigueur.
